Another high-profile incident in Folly Beach, SC, involved Jamie Lee Komoroski, who struck a newlywed couple’s golf cart after choosing to drink and drive. Samantha Miller, the bride, lost her life in the crash. Komoroski now faces a 25-year prison sentence for DUI manslaughter.

With safety now front and center, South Carolina implemented new golf cart laws effective May 22, 2025, aimed at preventing similar tragedies.

Key Requirements to Operate a Golf Cart on SC Highways

To legally drive a golf cart on public highways in South Carolina, owners must:

  • Obtain a permit decal and registration certificate from the DMV

  • Provide proof of ownership

  • Maintain liability insurance

  • Pay a $5 registration fee

Note: Permit decals must be renewed every 5 years or when the owner’s address changes—whichever comes first.

Where and When Golf Carts Are Allowed

Under House Bill 3292, golf carts can only be driven on roads with speed limits of 35 mph or less. Despite the term “highway” being used, this includes secondary roads and city streets—but not interstates or major roads with minimum speed limits over 45 mph.

If No Local Ordinance Exists:

Golf carts are only allowed:

  • During daylight hours

  • Within 4 miles of the address listed on the registration certificate or entrance of a gated community

  • To cross highways at intersections where speed limits exceed 35 mph

Local Rules May Differ

Cities and counties may enforce additional rules, such as:

  • Operating hours

  • Approved roads

  • Requirement for headlights and taillights

Municipalities may also create separate golf cart paths, provided they maintain a 4-foot buffer from traffic lanes or use parking spaces as barriers.

Age & License Requirements

To operate a golf cart in South Carolina:

  • You must be at least 16 years old

  • You must hold a valid driver’s license
